Resumen: Al usar auctionhall, aceptas estos términos. auctionhall es una plataforma que alquila salas virtuales para subastas en vivo. No somos parte de las transacciones entre subastadores y compradores. El subastador es responsable de sus productos y cumplimiento legal.

1. Aceptación de los Términos

Al acceder o usar auctionhall ("la Plataforma"), aceptas estar legalmente obligado por estos Términos y Condiciones. Si no aceptas, no debes usar la Plataforma.

Estos términos se aplican a todos los usuarios: subastadores, asistentes y visitantes. Cada tipo de usuario tiene derechos y responsabilidades específicas descritas a continuación.

2. Definiciones

Servicio	El alquiler de salas virtuales, streaming WebRTC, y herramientas asociadas

3. Elegibilidad y Registro

3.1 Elegibilidad

Debes tener al menos 18 años para crear una cuenta y usar la Plataforma. Al registrarte, declaras que tienes capacidad legal para celebrar contratos.

3.2 Registro de Subastador

Para registrarte como subastador, debes proporcionar:

Nombre completo o razón social
Correo electrónico válido
Número de teléfono
Documento de identidad o registro comercial
Dirección de facturación

La información debe ser veraz y actualizada. auctionhall se reserva el derecho de verificar la identidad y suspender cuentas con información falsa.

3.3 Registro de Asistente / Espectador

Todos los participantes de una sala —incluyendo pujadores y espectadores— deben registrarse e iniciar sesión con su nombre completo y correo electrónico. No existe acceso anónimo a ninguna sala. La participación en subastas requiere aceptar estos términos.

4. Servicios Proporcionados

4.1 Alquiler de Salas Virtuales

auctionhall provee infraestructura para realizar subastas en vivo, incluyendo:

Sala virtual con streaming WebRTC en tiempo real
Sistema de pujas en tiempo real
Chat en vivo entre participantes
Grabación automática de la sesión (MP4)
Gestión de productos/lotes
Procesamiento de pagos (Stripe y NowPayments)

4.2 Lo que auctionhall NO provee

Productos para subastar — el subastador es responsable de sus propios productos
Verificación de autenticidad de productos
Seguro para productos transportados
Servicio de logística o envío
Asesoría legal o fiscal
Garantía de venta exitosa

4.3 Monitoreo y Auditoría de Sesiones

Aviso importante: Todas las sesiones de subasta son grabadas automáticamente y pueden ser auditadas por el equipo de auctionhall ante cualquier denuncia o irregularidad. Si se detecta actividad ilegal o fraudulenta, auctionhall se reserva el derecho de reportar los hechos y los datos de identificación del usuario a las autoridades competentes del país de residencia del usuario.

Con el fin de garantizar la integridad de las subastas y proteger a todos los participantes, auctionhall implementa un sistema de auditoría de accesos que registra automáticamente por cada evento de sesión:

Dirección IP del usuario al ingresar a una sala o al alquilar una sala
País, ciudad y región derivados de la dirección IP
Proveedor de servicios de internet (ISP)
Tipo de navegador y sistema operativo utilizado
Fecha y hora exactas de cada acceso
Rol del usuario en la sesión (subastador o pujador)

Un mismo usuario puede tener múltiples registros si accede desde distintos dispositivos o ubicaciones. Esta información se conserva conforme a la Política de Privacidad y se utiliza exclusivamente para seguridad, investigación de irregularidades y cumplimiento legal.

5. Obligaciones del Subastador

5.1 Productos

El subastador es el único responsable de:

La legalidad de los productos que subasta
La exactitud de las descripciones e imágenes
Cumplir con las leyes de propiedad intelectual
No subastar productos prohibidos (ver sección 6)
Cumplir con las leyes fiscales aplicables a sus ventas
Entregar los productos vendidos a los compradores

5.2 Precios y Comisiones

El precio inicial de cada producto debe ser ≥ $1 USD
El incremento mínimo debe ser ≥ $1 USD
auctionhall cobra $20 USD por sala de 12 horas + un depósito de garantía de $10 USD
La comisión del 3% por venta se aplica sobre cada producto vendido exitosamente y se descuenta del depósito de garantía de $10 USD
Si la comisión total acumulada supera el depósito de $10 USD, el excedente queda como saldo pendiente y se cobra automáticamente en el próximo alquiler de sala
El cobro entre subastadores y compradores es responsabilidad exclusiva del subastador — auctionhall no retiene ni transfiere fondos entre compradores y subastadores en el modelo actual (la custodia de cobro es un servicio v2)
Pagos crypto tienen un recargo adicional del 2%

5.3 Cancelación

El subastador puede cancelar su sala mientras esté en estado pendiente de pago o reservada (antes de que comience)
Una sala en estado activa no puede cancelarse
Las salas en estado pendiente de pago cuyo horario de inicio haya pasado son canceladas automáticamente por el sistema cada hora — el pago puede realizarse el mismo día de la subasta, hasta el momento exacto de inicio
Ventana de cancelación: una sala reservada solo puede cancelarse con al menos 72 horas (3 días) de anticipación al horario de inicio. Pasada esa ventana, el botón de cancelación se desactiva y la cancelación no es posible
Reembolso del alquiler: si la cancelación es realizada dentro de la ventana permitida, el costo del alquiler ($20 USD) es acreditado al wallet del subastador para su próximo alquiler de sala
Depósito no reembolsable: el depósito de garantía ($10 USD) no se devuelve bajo ninguna circunstancia al cancelar, ya que representa el costo de haber reservado la fecha — esa fecha pudo haber sido ocupada por otro subastador
El depósito se devuelve al cierre de la sala (sin cancelación), descontada la comisión acumulada

5.4 Disponibilidad de salas y sistema de cupos

La plataforma opera con un límite de 5 salas activas por día calendario en toda la plataforma (sujeto a cambios según capacidad del servicio)
Los cupos son compartidos entre todos los subastadores y se asignan por orden de confirmación de pago
La fecha y el horario solo quedan reservados al confirmar el pago. Crear la sala sin completar el pago no genera ningún derecho sobre el cupo del día seleccionado
Las salas en estado pendiente de pago no consumen cupo diario — el cupo se descuenta únicamente al confirmar el pago
Si al momento de pagar el día ya está completo, la plataforma ofrece la opción de seleccionar una fecha alternativa sin costo adicional
Solo se permite 1 sala confirmada por subastador por día
No es posible crear una nueva sala mientras exista una sala pendiente de pago — debés completar o cancelar ese pago primero

5.5 Horario de salas

Las salas solo pueden configurarse con un horario de inicio desde las 06:00 (hora Argentina) del día elegido. No se admiten horarios anteriores a las 06:00 AM.
Las salas tienen una duración máxima de 12 horas desde el momento en que el subastador las inicia efectivamente.
Sin importar la hora de inicio, ninguna sala puede extenderse más allá de las 06:00 AM del día siguiente al día configurado. Si el cálculo de 12 horas superara ese límite, la sala finalizará automáticamente a las 06:00 AM.
Este horario garantiza que las salas de un día no se superpongan con las del día siguiente, reservando la madrugada para los subastadores que necesitan tiempo adicional.

6. Productos Prohibidos

Está estrictamente prohibido subastar los siguientes productos en auctionhall:

Armas de fuego, armas blancas prohibidas, explosivos
Drogas, sustancias controladas, fármacos sin receta
Animales vivos
Órganos humanos o partes del cuerpo
Material sexual explícito o pornografía
Documentos falsificados (identificaciones, diplomas, títulos)
Productos robados o de origen ilícito
Propiedad intelectual que infringe copyright o trademark
Cualquier artículo prohibido por las leyes del país de residencia del subastador
Cualquier artículo prohibido por leyes internacionales aplicables
Cualquier artículo prohibido por las leyes de los países donde se encuentren los participantes

El incumplimiento resultará en suspensión inmediata de la cuenta y posible reporte a autoridades.

7. Obligaciones del Asistente

Proporcionar información veraz al registrarse
Cumplir con los términos de la subasta (pagar dentro de las 24h si es ganador)
No usar la plataforma para actividades fraudulentas
No intentar manipular el sistema de pujas
Respetar las decisiones del subastador (expulsión de sala)

8. Pagos y Comisiones

8.1 Estructura de Cargos

Nota: auctionhall no retiene ni transfiere fondos entre compradores y subastadores en el modelo actual. El subastador coordina el cobro directamente con sus compradores. El servicio de custodia de cobro (v2) permitirá a futuro procesar pagos de compradores a través de la plataforma.

8.2 Métodos de Pago

Tarjeta de crédito/débito: Procesado por Stripe
Criptomonedas: Bitcoin (BTC), USDT, USDC, ETH, USDT-TRC20 y más de 200 activos vía NowPayments

8.3 Disputas de Pago

Si un asistente disputa un cargo (chargeback), auctionhall puede:

Bloquear fondos pendientes del subastador
Suspender la cuenta mientras se investiga
Compartir evidencia (registro de pujas) con el procesador de pagos

9. Propiedad Intelectual

9.1 Propiedad de auctionhall

Todos los derechos de propiedad intelectual sobre la Plataforma (código, diseño, marca, logotipos) pertenecen a Coresoft BS LLC. No se concede ninguna licencia para usar nuestra marca sin autorización escrita.

9.2 Contenido del Usuario

Al subir imágenes o descripciones a la Plataforma, el subastador:

Declara ser propietario o tener licencia para usar dicho contenido
Concede a auctionhall una licencia limitada para mostrar, almacenar y distribuir dicho contenido exclusivamente con fines de operación de la Plataforma
Puede eliminar su contenido en cualquier momento (las grabaciones se mantienen por 90 días desde el fin de la sesión)

9.3 Grabaciones

Las grabaciones MP4 son propiedad del subastador
auctionhall almacena las grabaciones por un período de 90 días a partir del fin de la sesión
El subastador puede descargarlas en cualquier momento durante ese período
Transcurridos 90 días, las grabaciones son eliminadas automáticamente sin previo aviso
auctionhall puede usar fragmentos de grabaciones con fines de marketing (con consentimiento previo)

10. Responsabilidad y Limitaciones

10.1 Limitación de Responsabilidad

auctionhall NO es responsable de:

La calidad, autenticidad o legalidad de los productos subastados
El incumplimiento del subastador de entregar productos vendidos
Daños indirectos, lucro cesante, o pérdidas consecuentes
Pérdidas financieras derivadas de subastas fallidas
Disputas entre subastadores y compradores
Interrupciones del servicio por causas de fuerza mayor

10.2 Indemnización

El subastador acepta indemnizar y mantener indemne a auctionhall y Coresoft BS LLC de cualquier reclamación, daño o gasto (incluyendo honorarios de abogados) que surja de:

El uso de la Plataforma por parte del subastador
La violación de estos términos
La violación de leyes aplicables
La infracción de derechos de terceros

10.3 Disponibilidad del Servicio

auctionhall no garantiza disponibilidad 100%. Podemos realizar mantenimiento programado (con 48h de anticipación) o interrupciones no programadas. No ofrecemos compensación por interrupciones menores a 24 horas.

11. Terminación y Suspensión

11.1 Terminación por el Usuario

Puedes eliminar tu cuenta en cualquier momento desde la configuración. La eliminación:

Es irreversible
Elimina tu perfil y datos personales (conforme a la política de privacidad)
No cancela transacciones pendientes
No genera reembolsos por salas ya pagadas

11.2 Suspensión por auctionhall

Podemos suspender o terminar tu cuenta si:

Violas estos términos
Subastas productos prohibidos
Tienes comportamiento fraudulento o irregular detectado mediante el sistema de auditoría de accesos
Tienes comisiones impagas por más de 30 días
Recibimos una orden judicial o requerimiento legal
Las grabaciones o registros de auditoría evidencian actividad que viola estas condiciones o la ley aplicable

El bloqueo de cuenta puede ser temporal o definitivo, según la gravedad del incumplimiento. En caso de bloqueo, recibirás una notificación por email indicando el motivo. Para solicitar una revisión, contacta a support@auctionhall.click.

En casos de actividad ilegal confirmada, auctionhall puede compartir los datos de identificación del usuario (incluyendo dirección IP, geolocalización e historial de acceso) con las autoridades competentes de su país de residencia, sin necesidad de notificación previa al usuario.

12. Disputas y Resolución

12.1 Entre Usuarios

auctionhall no es parte en disputas entre subastadores y compradores. Recomendamos resolver las disputas directamente. La plataforma provee:

Registro inmutable de todas las pujas
Grabaciones de la sesión
Historial de transacciones

12.2 Con auctionhall

Las disputas con auctionhall se resolverán siguiendo este proceso:

Contacto inicial a soporte (support@auctionhall.click)
Revisión interna (máximo 15 días hábiles)
Mediación (si es necesario)
Jurisdicción: tribunales de la Ciudad de Panamá, República de Panamá

13. Ley Aplicable

Estos términos se rigen por las leyes de la República de Panamá. Para disputas legales, las partes se someten a la jurisdicción exclusiva de los tribunales de la Ciudad de Panamá.

14. Cambios en los Términos

auctionhall se reserva el derecho de modificar estos términos en cualquier momento. Los cambios significativos se notificarán por email con 30 días de anticipación. El uso continuado después de los cambios constituye aceptación.

Summary: By using auctionhall, you accept these terms. auctionhall is a platform that rents virtual rooms for live auctions. We are not party to transactions between auctioneers and buyers. The auctioneer is responsible for their products and legal compliance.

1. Acceptance of Terms

By accessing or using auctionhall ("the Platform"), you agree to be legally bound by these Terms and Conditions. If you do not accept them, you must not use the Platform.

These terms apply to all users: auctioneers, attendees, and visitors. Each user type has specific rights and responsibilities described below.

2. Definitions

3. Eligibility and Registration

3.1 Eligibility

You must be at least 18 years old to create an account and use the Platform. By registering, you declare that you have the legal capacity to enter into contracts.

3.2 Auctioneer Registration

To register as an auctioneer, you must provide:

Full name or company name
Valid email address
Phone number
Government-issued ID or commercial registration
Billing address

Information must be accurate and up to date. auctionhall reserves the right to verify identity and suspend accounts with false information.

3.3 Attendee / Spectator Registration

All room participants — including bidders and spectators — must register and log in with their full name and email address. Anonymous access to any room is not permitted. Participation in auctions requires acceptance of these terms.

4. Services Provided

4.1 Virtual Room Rental

auctionhall provides infrastructure for live auctions, including:

Virtual room with real-time WebRTC streaming
Real-time bidding system
Live chat between participants
Automatic session recording (MP4)
Product/lot management
Payment processing (Stripe and NowPayments)

4.2 What auctionhall does NOT provide

Products to auction — the auctioneer is responsible for their own products
Product authenticity verification
Insurance for transported products
Logistics or shipping services
Legal or tax advice
Guarantee of successful sale

4.3 Session Monitoring and Auditing

Important notice: All auction sessions are automatically recorded and may be audited by the auctionhall team in the event of any complaint or irregularity. If illegal or fraudulent activity is detected, auctionhall reserves the right to report the facts and user identification data to the competent authorities in the user's country of residence.

In order to ensure the integrity of auctions and protect all participants, auctionhall implements an access audit system that automatically records for each session event:

User's IP address upon entering a room or renting a room
Country, city, and region derived from the IP address
Internet service provider (ISP)
Browser type and operating system used
Exact date and time of each access
User's role in the session (auctioneer or bidder)

A single user may have multiple records if they access from different devices or locations. This information is retained in accordance with our Privacy Policy and is used solely for security purposes, investigation of irregularities, and legal compliance.

5. Auctioneer Obligations

5.1 Products

The auctioneer is solely responsible for:

The legality of the products they auction
The accuracy of descriptions and images
Compliance with intellectual property laws
Not auctioning prohibited products (see section 6)
Compliance with applicable tax laws on their sales
Delivering sold products to buyers

5.2 Pricing and Commissions

The starting price of each product must be ≥ $1 USD
The minimum increment must be ≥ $1 USD
auctionhall charges $20 USD per 12-hour room + a $10 USD security deposit
A 3% commission applies to each successfully sold product and is deducted from the $10 security deposit
If the total accumulated commission exceeds the $10 deposit, the excess becomes a pending balance automatically charged on the next room rental
Payment collection between auctioneers and buyers is the auctioneer's sole responsibility — auctionhall does not hold or transfer funds between buyers and auctioneers in the current model (payment custody is a v2 service)
Crypto payments carry an additional 2% surcharge

5.3 Cancellation

The auctioneer may cancel their room while it is in pending payment or reserved status (before it starts)
A room in active status cannot be cancelled
Rooms in pending payment status whose scheduled start time has passed are automatically cancelled by the system hourly — payment can be made on the same auction day, up to the exact scheduled start time
Cancellation window: a reserved room may only be cancelled with at least 72 hours (3 days) notice before the scheduled start time. Once this window has passed, the cancellation button is disabled and cancellation is no longer possible
Rental refund: if cancellation is made within the permitted window, the rental fee ($20 USD) is credited to the auctioneer's wallet for use on their next room rental
Non-refundable deposit: the security deposit ($10 USD) is never returned upon cancellation, as it represents the cost of having reserved the date — that date slot could have been taken by another auctioneer
The deposit is returned at room close (without cancellation), minus any accumulated commission

5.4 Room Availability and Capacity

The platform operates with a limit of 5 active rooms per calendar day across the entire platform (subject to change based on service capacity)
Slots are shared among all auctioneers and assigned in order of payment confirmation
Date and time are only reserved upon payment confirmation. Creating a room without completing payment grants no right to the selected day's slot
Rooms in pending payment status do not consume a daily slot — the slot is deducted only upon payment confirmation
If the day is full at the time of payment, the platform offers the option to select an alternative date at no extra cost
Only 1 confirmed room per auctioneer per day is allowed
It is not possible to create a new room while a pending payment room exists — you must complete or cancel that payment first

5.5 Room Hours

Rooms may only be scheduled with a start time from 06:00 AM (Argentina time) on the chosen day. Start times before 06:00 AM are not permitted.
Rooms have a maximum duration of 12 hours from the moment the auctioneer effectively starts them.
Regardless of start time, no room may run past 06:00 AM of the day following the configured date. If the 12-hour calculation would exceed that limit, the room will automatically end at 06:00 AM.
This schedule ensures that rooms from one day do not overlap with those of the next, while reserving the early morning hours for auctioneers who need additional time.

6. Prohibited Products

It is strictly prohibited to auction the following products on auctionhall:

Firearms, prohibited bladed weapons, explosives
Drugs, controlled substances, prescription pharmaceuticals
Live animals
Human organs or body parts
Explicit sexual content or pornography
Forged documents (IDs, diplomas, degrees)
Stolen or illicitly obtained products
Intellectual property infringing copyright or trademark
Any item prohibited by the laws of the auctioneer's country of residence
Any item prohibited by applicable international laws
Any item prohibited by the laws of the countries where participants are located

Violation will result in immediate account suspension and possible reporting to authorities.

7. Attendee Obligations

Provide accurate information when registering
Comply with auction terms (pay within 24h if a winner)
Not use the platform for fraudulent activities
Not attempt to manipulate the bidding system
Respect the auctioneer's decisions (removal from room)

8. Payments and Commissions

8.1 Charge Structure

Note: auctionhall does not hold or transfer funds between buyers and auctioneers in the current model. The auctioneer coordinates payment collection directly with their buyers. The payment custody service (v2) will enable processing buyer-to-auctioneer payments through the platform in the future.

8.2 Payment Methods

Credit/debit card: Processed by Stripe
Cryptocurrencies: Bitcoin (BTC), USDT, USDC, ETH, USDT-TRC20, and 200+ assets via NowPayments

8.3 Payment Disputes

If an attendee disputes a charge (chargeback), auctionhall may:

Block pending funds from the auctioneer
Suspend the account during investigation
Share evidence (bid records) with the payment processor

9. Intellectual Property

9.1 auctionhall's Property

All intellectual property rights over the Platform (code, design, brand, logos) belong to Coresoft BS LLC. No license is granted to use our brand without written authorization.

9.2 User Content

By uploading images or descriptions to the Platform, the auctioneer:

Declares ownership or license to use such content
Grants auctionhall a limited license to display, store, and distribute such content solely for Platform operation purposes
May delete their content at any time (recordings are retained for 90 days from the session end)

9.3 Recordings

MP4 recordings are the property of the auctioneer
auctionhall stores recordings for 90 days from the end of the session
The auctioneer may download them at any time during that period
After 90 days, recordings are automatically deleted without prior notice
auctionhall may use recording fragments for marketing purposes (with prior consent)

10. Liability and Limitations

10.1 Limitation of Liability

auctionhall is NOT responsible for:

The quality, authenticity, or legality of auctioned products
The auctioneer's failure to deliver sold products
Indirect damages, lost profits, or consequential losses
Financial losses from failed auctions
Disputes between auctioneers and buyers
Service interruptions due to force majeure

10.2 Indemnification

The auctioneer agrees to indemnify and hold harmless auctionhall and Coresoft BS LLC from any claims, damages, or expenses (including attorney's fees) arising from:

The auctioneer's use of the Platform
Violation of these terms
Violation of applicable laws
Infringement of third-party rights

10.3 Service Availability

auctionhall does not guarantee 100% availability. We may perform scheduled maintenance (with 48h notice) or unscheduled interruptions. We offer no compensation for interruptions shorter than 24 hours.

11. Termination and Suspension

11.1 User Termination

You may delete your account at any time from settings. Deletion:

Is irreversible
Removes your profile and personal data (per the privacy policy)
Does not cancel pending transactions
Does not generate refunds for already-paid rooms

11.2 auctionhall Suspension

We may suspend or terminate your account if:

You violate these terms
You auction prohibited products
You engage in fraudulent or irregular behavior detected through the access audit system
You have unpaid commissions for more than 30 days
We receive a court order or legal requirement
Recordings or audit logs evidence activity that violates these terms or applicable law

Account blocking may be temporary or permanent depending on the severity of the breach. If blocked, you will receive an email notification explaining the reason. To request a review, contact support@auctionhall.click.

In cases of confirmed illegal activity, auctionhall may share user identification data (including IP address, geolocation, and access history) with the competent authorities in the user's country of residence, without prior notification to the user.

12. Disputes and Resolution

12.1 Between Users

auctionhall is not party to disputes between auctioneers and buyers. We recommend resolving disputes directly. The platform provides:

Immutable record of all bids
Session recordings
Transaction history

12.2 With auctionhall

Disputes with auctionhall will be resolved following this process:

Initial contact to support (support@auctionhall.click)
Internal review (maximum 15 business days)
Mediation (if necessary)
Jurisdiction: courts of Panama City, Republic of Panama

13. Governing Law

These terms are governed by the laws of the Republic of Panama. For legal disputes, the parties submit to the exclusive jurisdiction of the courts of Panama City.
